Resumo:

O presente artigo tem como objetivo apresentar a concepção de justiça em Nietzsche a partir da segunda fase de seu pensamento em obras como Genealogia da moral, Aurora e Humano, demasiado humano. Trata-se da perspectiva genealógica em que a justiça como ‘em si’ e ‘verdade eterna’ são desconstruídas para problematizar a concepção de direito como aporte da ‘justiça’ nas lutas feministas. Que ‘justiça’ buscam as mulheres? Seria isto possível ou a relação entre poder, direito e justiça já estaria comprometida com uma moralidade androcêntrica? A fim de compreender tal questão, traremos ao encontro de Nietzsche, Carol Smart, A mulher do discurso jurídico (1992), para quem o direito, poder gendrado, é impossibilidade de ‘justiça’, embora também seja palco de resistência.

Abstract:

This article aims to demonstrate Nietzsche's conception of justice from the second phase of his thinking in works such as Genealogy of morals, The Dawn of Day, and Human, All too human. It is about the genealogical perspective in which justice as 'in itself' and 'eternal truth' are deconstructed to problematize the conception of law as a contribution of 'justice' to feminist struggles. What 'justice' do women seek? Is this possible or is the relationship between power, law and justice already committed to an androcentric morality? In order to understand this issue, we will bring to the meeting of Nietzsche, Carol Smart, The woman in legal discourse (1992), for whom the law, gendered power, is the impossibility of 'justice', although it is also the stage of resistance.
